A second-generation solution to electronic waste: the New York approach

Abstract/summary

This Note examines how New York’s approach to e-‐waste disposal addresses prominent challenges to the adoption of e‐waste recycling programs, and argues that EERRA is the model most likely to succeed in increasing e-‐waste recycling. Part I reviews state e-‐waste legislation and explains New York’s multifaceted approach under EERRA. Part II examines the evolution from early state laws to EERRA, includingalternative state approaches and the challenges of coverage, enforcement, and financing. Part III considers future state and federal action, addressing the feasibility of using EERRA as a blueprint for state and federal e‐waste regulation.
