EPR LAW FRAMEWORK In May 2016 Chile passed an EPR Law to promote recycling throughout the whole country. The Law was inspired by European directives to define the rules to establish collective and individual compliance schemes (PRO - Product Recovery Organization). These policies made six priority products subject to recovery targets: packaging, WEEE, used oils, tyres, car batteries, and batteries. The law established a full producer responsibility and the rules for non-profit PROs composed only by Producers. The Law defines a Producer of a priority product as a person who, regardless of the marketing technique: • Alienates a priority product for the first time into the domestic market. • Alienates under its own brand a priority product purchased from a third party that is not the first distributor. • Imports a priority product for own professional use. • In the case of packaging, the producer is the one who introduces packaged consumer goods into the market. Waste pickers can participate in the waste collection and sorting processes as formal contractors while they are registered and duly certified under the framework of the National System of Certification of Labour Competencies.
