Abstract/summary

This work analyzes the implementation of Law No. 27279/16, that incorporates extended producer responsibility (EPR) into Argentine legislation and regulates the management of empty phytosanitary containers. We are interested in generating contributions to the development of other REP regulations for different conteniers and materials. A qualitative analysis is used, based on interviews with key actors and consultation of secondary sources. It is concluded that in the design of an REP law, the specificities of the products and materials must be considered and that enabling private management of waste (formerly packaging) without paying for adequate evaluation and state monitoring, causes significant failures in its implementation. Furthermore, the lack of incentives to modify the behavior of actors involved in the reverse logistics of packaging leads them to prefer to maintain the status while shared weaken the effectiveness of the law. Este trabajo analiza la implementación de la Ley N° 27279/16, que incorpora la responsabilidad extendida del productor (REP) en la legislación Argentina y regula la gestión de los envases vacíos de fitosanitarios. Interesa generar aportes al desarrollo de otras normativas REP para diferentes envases y materiales. Se recurre a un análisis de tipo cualitativo, basado en entrevistas con actores clave y consulta a fuentes secundarias. Se concluye que en el diseño de una ley REP deben considerarse las especificidades de los productos y materiales y que habilitar la gestión privada de los residuos (antes envases) sin costear una adecuada evaluación y monitoreo estatal ocasiona fallas significativas en su implementación. Además, la falta de incentivos para modificar comportamientos de actores que intervienen en la logística inversa de los envases lleva a que estos prefieran mantener el statu quo, mientras que las responsabilidades compartidas debilitan la eficacia de la ley.
