Staff requests disapproval of the October, 2016 California Carpet Stewardship Plan 2017-2021, submitted by the Carpet America Recovery Effort (CARE), the stewardship organization designated by carpet manufactures that sell carpet in California to carry out their responsibilities under the law (see Attachment 1, hereafter referred to as the "2017 Plan"), pursuant to the carpet stewardship law (Public Resources Code (PRC) §970-42983). Staff reviewed the 201 7 Plan, compared it to the requirements in statute and regulations, and found it does not meet the requirements of PRC 42970 et seq. to show how it will ensure "continuous meaningful improvement" in recycling and diverting carpet from landfills in the state. Options: I. Disapprove the 2017 Plan. Direct CARE to submit a revised 2017 Plan, within 60 days, that addresses the Findings contained in this Request for Approval. Allow CARE to continue to operate under the existing Carpet Stewardship Plan until a new Plan is approved, but for no more than 120 days. If a revised Plan is not approved within 120 days, direct staff to take enforcement actions as appropriate against manufacturers of carpet sold in California that is not subject to an approved plan. 2. Approve the 2017 Plan. Recommendation: Staff recommend Option 1, disapproval of the 2017 Plan with respect to meeting the statutory requirements of PRC §42970 et seq., for the reasons set forth in the findings below.
